ARTICLE 1 – APPLICATION
These General Terms and Conditions of Sale are presented to each purchaser to enable them to place an order.
Consequently, placing an order implies the Buyer’s full and unreserved acceptance of the GTC.
No special terms and conditions may prevail over these General Terms and Conditions of Sale unless formally accepted in writing by the Seller.
Any contrary condition set forth by the Buyer shall therefore, in the absence of express acceptance, be unenforceable against the Seller, regardless of when it may have been brought to the Seller’s attention.
The fact that the Seller does not invoke any of these T&Cs at a given time shall not be construed as a waiver of the right to invoke any of said terms at a later date.
ARTICLE 2 – ORDER
To be valid, all orders must be placed directly on the website www.kif-kiff.com
All orders are deemed firm and final upon acceptance of the T&Cs.
Elixol does not sell to minors in their country; therefore, by accepting these Terms and Conditions, you certify that you are over 18 years of age.
Once confirmed, an order is generally processed within 24 hours (business days).
ARTICLE 3 – ORDER MODIFICATIONS
Any modification requested by the Buyer can only be considered if it is received in writing before the order status changes to “Preparation.”
Any modification made to an order automatically results in the cancellation of the terms previously accepted by the Seller regarding prices, delivery times, payment terms, and delivery methods.
Such changes may result in the Seller’s complete cancellation of the order, without any compensation being claimable from the Seller.
In the event of cancellation after the goods have been shipped, as shipping costs are the responsibility of the Buyer, the Buyer shall bear both the original shipping costs and the costs of return shipping.
These costs will not be refunded by the Seller.
ARTICLE 4 – DELIVERY – DELIVERY TIMES
Deliveries are made only based on availability and in the order in which orders are received.
The Seller is authorized to make full or partial deliveries.
The delivery times listed on the website are provided for informational purposes only; they are generally 24–48 hours.
In the event of a stock shortage or difficulty in restocking, the delivery times listed on the website may be exceeded.
After thirty days, the buyer may request cancellation of their order and a full refund of any amounts already paid.
The delivery period is defined as the time between the shipment of the order and its receipt.
ARTICLE 5 – DELIVERY – TRANSFER OF RISK
The goods are delivered free of shipping charges.
The goods are shipped at the recipient’s risk; in the event of damage or missing items, it is the recipient’s responsibility to make all necessary observations and to confirm any reservations via an extrajudicial document or by registered letter with return receipt to the carrier within 3 days of receiving the goods.
ARTICLE 6 – ACCEPTANCE
Without prejudice to any measures to be taken against the carrier or the Seller’s employee if the delivery is made by the Seller, complaints regarding apparent defects or non-conformity of the delivered goods with respect to the order or the shipping manifest must be made in writing within 8 days of delivery of the goods.
It shall be the Buyer’s responsibility to provide evidence of the existence of any defects or anomalies found.
The Buyer must allow the Seller every opportunity to verify these defects and to remedy them.
The buyer shall refrain from using the goods for the time necessary for the seller to remedy the identified defect.
If the defect is confirmed, the goods will be replaced, with the delivery costs for the exchanged goods borne by the Seller.
ARTICLE 7 – RIGHT OF WITHDRAWAL – TERMS – CONSEQUENCES
In the context of a distance sale, by mail order, or online, the consumer has a right of withdrawal of 14 calendar days from receipt of the product, without having to provide a reason or pay any penalties, except for return shipping costs.

The product must be returned in its original packaging, complete and in good condition, within 14 days of the purchase date (as evidenced by the postmark).
A refund will be issued within 14 days of receipt of the returned product. Any merchandise returned without prior approval will be held for the purchaser and will not be eligible for a refund. The costs and risks of return are the responsibility of the buyer.
ARTICLE 8 – COMPLAINTS – DEFECTIVE OR NON-CONFORMING PRODUCTS

All complaints will be processed within a maximum of 14 business days.
A refund or replacement of the product will be issued after a qualitative and quantitative inspection of the returned merchandise.
ARTICLE 9 – WARRANTIES – SCOPE OF APPLICATION
Our products are covered by the legal warranty of conformity and the warranty against hidden defects provided for in Articles L.217-4 et seq. of the Consumer Code and Articles 1641 et seq. of the Civil Code.
The equipment is covered by a 6-month manufacturer’s warranty, unless otherwise indicated on the product sheet.
To invoke the warranty, the buyer must provide the warranty certificate or the paid purchase invoice. Otherwise, the warranty cannot be applied.
Prior approval from Customer Service is required before any return or replacement.
ARTICLE 10 – WARRANTY EXCLUSIONS
The warranty does not cover defects or damage resulting from the following:
Failure to follow the safety instructions or storage conditions indicated on the product packaging.
Improper or abnormal use of the product.
Lack of maintenance or improper maintenance of the device.
Inadequate electrical protection of the devices or negligence.
Modification or alteration of the product not authorized by the Seller.
Use under abnormal conditions or for purposes other than those intended.
Furthermore, the warranty does not apply to apparent defects, which must be reported upon receipt of the product, in accordance with the provisions of Article 8.
The warranty is personal to the purchaser: it does not apply to third parties to whom the merchandise may have been given or transferred.
Any use outside normal conditions results in the immediate exclusion from the warranty, either partially or totally, as the case may be.
ARTICLE 11 – PRICES
Prices are those listed in the price list in effect on the day of the order.
ARTICLE 12 – PAYMENT – LATE PAYMENT
Any partial payment is considered a down payment.
Goods are payable upon order, unless otherwise specified.
No delivery will be made until the amounts due have been received.
In the event of payment in installments, if the contract is terminated due to non-payment of an installment by its due date, any amounts previously paid by the buyer shall be retained by the seller.
Similarly, the defaulting buyer shall be liable for a lump-sum indemnity equivalent to the amount of the remaining installments.
The buyer must reimburse all costs incurred in the collection of the amounts due through legal proceedings.
In the event of deferred payment agreed upon at the time of the order, regardless of the form of credit chosen until full payment is made, the goods must be in good condition and may not be sold, given away, or pledged as collateral, and must be stored under the recommended storage conditions.
ARTICLE 13 – RETENTION OF TITLE
The transfer of ownership of the item sold is contingent upon payment of the price by the purchaser upon the due date.
Payment is deemed to have been made upon actual receipt of the price, the delivery of a promissory note, or any other instrument creating an obligation to pay but not constituting payment.
ARTICLE 14 – DISCLAIMER
All products marketed by the Elixol brand are intended for the reproduction of smoke inhalation.
Products used to simulate vaporization are based on Propylene Glycol and Vegetable Glycerin.
As no scientific studies have been conducted on the side effects that may be associated with the absorption of these substances, the customer acknowledges that they use this product under their full and sole responsibility; Elixol cannot therefore be held liable for any health-related issues experienced by any of its customers.
The excessive use of the various products may also not be held against Elixol in the event of unwanted side effects.
ARTICLE 15 – EXCLUSIVE JURISDICTION
Any dispute arising from the interpretation, performance, or termination of the contract shall, in the event of a dispute for any reason whatsoever, be submitted to the courts having jurisdiction over the seller’s place of business.
ARTICLE 16 – DATA PROTECTION
In accordance with Law No. 78-17 on Data Protection, the purchaser has the right to access and correct personal information concerning them. This right may be exercised by submitting a written request to the seller, whose contact information is listed in the “Contact” section of the kif-kiff.com website
Since the information you provide is essential for processing and shipping orders, as well as for issuing invoices and warranty agreements, failure to provide it will result in the cancellation of your order.
By registering on the Site, you agree to provide us with accurate and truthful information about yourself.
Providing false information is contrary to these Terms and Conditions as well as the Terms of Use listed on the Site.
You have a permanent right to access and correct all data concerning you, in accordance with applicable European regulations and national laws (Article 34 of the Law of January 6, 1978). You may at any time submit a request to kif-kiff.com to find out what information it holds about you.
You may modify this data at any time upon request. If you agreed to receive promotional emails (e-mails) when you registered on the Site, you will be sent emails featuring new arrivals, clearance sales, exclusive offers, and special deals.
You may request to stop receiving emails from us at any time. kif-kiff.com is the sole holder of your personal information.
If you agreed to this when registering on the Site, Elixol may send you information as part of specific, one-time promotional campaigns.
